Overview of EU AI Act Documentation Requirements
The EU AI Act (Regulation (EU) 2024/1689) establishes the most comprehensive documentation requirements for AI systems anywhere in the world. Documentation is not an afterthought in this regulation — it is the central mechanism through which compliance is demonstrated, assessed, and enforced.
The documentation requirements serve multiple purposes within the regulatory framework. They provide evidence for conformity assessment — without adequate documentation, a high-risk AI system cannot receive conformity marking and cannot legally be placed on the EU market. They enable market surveillance by giving national authorities a detailed record they can review during inspections. They support transparency by ensuring that deployers receive the information they need to use AI systems responsibly. And they facilitate accountability by creating a traceable record of how the system was designed, developed, tested, and deployed.
The documentation obligations in the EU AI Act are distributed across several articles and annexes:
- Article 11 establishes the core technical documentation obligation for providers of high-risk AI systems
- Annex IV defines the 12 specific sections that technical documentation must contain
- Article 12 requires automatic logging and record-keeping capabilities
- Article 13 imposes transparency and information provision requirements
- Article 17 mandates a quality management system that documents organizational processes
- Article 18 requires document retention for at least 10 years after the AI system is placed on the market
- Article 26 establishes deployer-specific documentation obligations
- Article 53 defines documentation requirements for general-purpose AI models
Understanding the full scope of these requirements is essential because compliance failures in documentation are among the easiest for authorities to identify and enforce. Unlike technical performance issues that may require testing to detect, documentation gaps are immediately visible during review. Organizations that underinvest in documentation become the lowest-hanging fruit for enforcement action.
The financial stakes reinforce this point. Under Article 99, failing to meet high-risk AI documentation requirements exposes providers to fines of up to €15 million or 3% of global annual turnover, whichever is higher. For large organizations, the turnover-based calculation can produce fines substantially exceeding the fixed cap.
Article 11: Technical Documentation Obligations
Article 11 of the EU AI Act is the cornerstone of the regulation's documentation framework. It imposes three key obligations on providers of high-risk AI systems.
Obligation 1: Pre-market documentation. Technical documentation must be drawn up before the high-risk AI system is placed on the market or put into service. This means documentation is not something you produce retroactively — it must be ready at the point of market entry. The documentation must demonstrate that the system has been designed and developed in conformity with the requirements of Articles 8 through 15.
Obligation 2: Ongoing maintenance. Article 11 requires that technical documentation be kept up to date. This is not a passive obligation. As the AI system evolves through retraining, fine-tuning, data updates, or changes in operational context, the documentation must be revised to reflect the system's current state. The documentation should always describe the system as it exists today, not as it existed when it was first placed on the market.
Obligation 3: Annex IV compliance. Article 11(1) explicitly references Annex IV as defining the content requirements for technical documentation. The documentation must contain at minimum the elements listed in Annex IV, covering all 12 sections. Providers may include additional information beyond what Annex IV requires, but they cannot omit any of the specified sections.
Article 11 also recognizes the practical challenges of documentation for different organizational contexts. Article 11(2) allows small and micro enterprises to fulfill certain documentation elements in a simplified manner, provided they still cover all Annex IV sections. The European Commission is empowered to develop standardized forms for simplified documentation, though these standards are still being developed through harmonized standard-setting processes.
It is important to understand what Article 11 does not say. It does not prescribe a specific document format (PDF, web-based, structured data). It does not require a single monolithic document — the required information can be organized across multiple documents as long as all Annex IV elements are covered and readily accessible. And it does not limit documentation to the provider's internal use — the documentation must be available to conformity assessment bodies, market surveillance authorities, and (in part) to deployers.
The practical implication is clear: providers should establish their documentation framework early in the development process, build documentation incrementally as the system develops, and implement processes to keep documentation current after deployment.
Annex IV: Required Documentation Sections
Annex IV defines 12 mandatory sections for the technical documentation of high-risk AI systems. Here is each section with the specific information that must be included.
1. General description of the AI system. The system's intended purpose, provider name and address, system version, how the system interacts with external hardware or software, the forms in which it is placed on the market (software package, API, embedded product), and the hardware it is designed to run on.
2. Detailed description of the development process. Design specifications including the general logic and algorithms, key design choices and their rationale, the system's architecture, computational resources used in development, and for machine learning systems: the learning approach, training methodologies, training data processing, and the decision-making approach used.
3. Monitoring, functioning, and control. The system's capabilities and performance limitations, the degrees of accuracy achieved and expected, foreseeable unintended outcomes and sources of risk to health, safety, and fundamental rights, the technical measures for human oversight, and specifications for input data.
4. Risk management system. Full documentation of the risk management process under Article 9, including identified risks, risk assessment results, residual risk evaluation, adopted mitigation measures, and testing evidence demonstrating the effectiveness of those measures.
5. Changes throughout the lifecycle. A record of all modifications to the system from initial development through current version, including what was changed, when, by whom, and why. This creates the audit trail that authorities review during market surveillance.
6. Performance metrics and accuracy levels. The system's declared levels of accuracy, robustness, and cybersecurity as required by Article 15, including the validation and testing procedures used, the metrics selected, the test datasets used, and the results achieved.
7. Training, validation, and testing data. Datasets used, their origin and scope, data characteristics, preparation measures (annotation, labeling, cleaning), data quality assessment, identification of any gaps or shortcomings, and bias examination results. For systems processing personal data, the data protection measures applied.
8. Cybersecurity measures. Technical protections against adversarial attacks, data poisoning, model manipulation, and unauthorized access. Vulnerability assessment findings and incident response procedures.
9. Computational resources. The resources consumed during development, training, testing, and validation, and the resources required for deployment and operation.
10. Quality management system. Description of the quality management system in place as required by Article 17, including organizational policies, design and development procedures, testing methodologies, and data management practices.
11. Instructions for use. Clear, comprehensive instructions provided to deployers covering the system's characteristics, capabilities, and limitations of performance, changes to the system pre-determined by the provider, human oversight measures, computational and hardware requirements, and the expected operational lifetime.
12. Foreseeable misuse and additional risks. Description of foreseeable misuse scenarios and the additional risks they pose, along with measures taken to address them.
Documentation Requirements by Provider vs Deployer
The EU AI Act assigns different documentation obligations to providers and deployers of high-risk AI systems. Understanding these distinct roles is critical because many organizations act as both provider and deployer for different systems.
Provider obligations. Providers — the organizations that develop or commission the development of high-risk AI systems and place them on the market — bear the primary documentation burden. Their obligations include:
- Preparing complete Annex IV technical documentation before market placement (Article 11)
- Maintaining and updating documentation throughout the system lifecycle (Article 11)
- Establishing and documenting a quality management system (Article 17)
- Retaining documentation for at least 10 years after the system is placed on the market (Article 18)
- Making documentation available to national competent authorities on request (Article 21)
- Providing deployers with instructions for use and relevant technical information (Article 13)
- Preparing an EU declaration of conformity (Article 47)
- Drawing up post-market monitoring plans (Article 72)
Deployer obligations. Deployers — organizations that use high-risk AI systems under their authority — have documentation obligations focused on responsible use and impact assessment. Their obligations include:
- Documenting that they use the system in accordance with the provider's instructions for use (Article 26(1))
- Conducting and documenting a fundamental rights impact assessment before putting the system into use, for certain categories of deployers (Article 27)
- Keeping logs automatically generated by the system for at least six months, or longer where applicable under EU or national law (Article 26(6))
- Informing the provider and relevant authorities when they identify a risk or serious incident (Article 26(5))
- Documenting human oversight measures implemented in their operational context (Article 26(2))
- Cooperating with market surveillance authorities by providing access to documentation and logs (Article 26(8))
Overlap scenarios. When an organization modifies a high-risk AI system substantially, or places it on the market under its own name, it assumes provider obligations regardless of whether it originally developed the system. This means organizations that customize, fine-tune, or rebrand third-party AI systems may need to produce full Annex IV documentation — even if the original provider already has their own documentation.
Practical recommendation. If you deploy AI systems developed by others, request their Annex IV documentation as part of procurement due diligence. Verify that the documentation is complete and current. Your deployer obligations are easier to fulfill when you have access to comprehensive provider documentation.

Timeline and Enforcement
The EU AI Act's documentation requirements take effect on a phased timeline. Understanding when each obligation becomes enforceable helps organizations prioritize their compliance efforts.
February 2, 2025: Prohibited practices. Article 5 prohibitions became enforceable. Organizations must document that they have screened their AI systems against the seven prohibited categories and ceased any prohibited activities. While this is not a documentation-heavy obligation, maintaining evidence of the screening process is essential.
August 2, 2025: GPAI model obligations. Providers of general-purpose AI models must meet their documentation obligations under Articles 53–55. This includes technical documentation about the model's training and testing processes, policies for complying with EU copyright law, and a sufficiently detailed summary about the content used for training. GPAI models with systemic risk face additional requirements including adversarial testing documentation and incident reporting.
August 2, 2026: High-risk system requirements. This is the critical deadline for documentation. All high-risk AI system requirements become enforceable, including the full Article 11 and Annex IV documentation obligations. Providers must have complete technical documentation in place before placing high-risk systems on the market after this date. Existing systems already on the market may have transitional provisions, but new deployments require full compliance.
February 2, 2027: Full enforcement. All remaining provisions take effect. The entire regulatory framework is operational, including requirements that were subject to extended transitional periods.
Enforcement mechanisms. The EU AI Act creates a multi-layered enforcement structure. The European AI Office oversees GPAI model providers and coordinates cross-border enforcement. National market surveillance authorities in each EU member state handle high-risk AI system oversight. These authorities have the power to:
- Request and review technical documentation (Article 21)
- Require providers to take corrective action (Article 16)
- Order the withdrawal or recall of non-compliant systems from the market
- Impose fines based on the penalty structure in Article 99
Penalty structure for documentation failures:
- Providing incorrect, incomplete, or misleading information to authorities: up to €7.5 million or 1.5% of global turnover
- Failing to meet high-risk system documentation requirements: up to €15 million or 3% of global turnover
- Deploying prohibited AI systems: up to €35 million or 7% of global turnover
Practical timeline for compliance readiness. Working backward from August 2026, organizations should complete their AI system inventory and risk classification by Q4 2025, begin producing Annex IV documentation for high-risk systems by Q1 2026, conduct internal documentation reviews and gap assessments by Q2 2026, and engage conformity assessment bodies by mid-2026. This timeline leaves a safety margin for addressing issues discovered during the process, which experience suggests will be substantial.
